Material Updates: BCN updates this Privacy Policy effective as of the date set forth below. Some material changes include, without limitation, a notice regarding California and New Jersey residents.  Please review the entire Privacy Policy below and if you do not agree to any portion of the revised Privacy Policy, then please cease using or viewing BCN’s website.

BCN Telecom, Inc. (“BCN”) is committed to protecting its website and app users’ and its customers’ privacy.  This privacy policy (“Privacy Policy”) applies to all information that BCN collects through your use of BCN’s website, www.bcntele.com  or its MobileApp, which is found on the google or Apple play store (BCN’s website and MobileApp are collectively referred to as the “Site”) or through any links on BCN’s Site, including but not limited to BCN’s customer and agent portals found at BCN Telecom Login.  While viewing or using BCN’s Site or any links therein you accept and agree to all of the terms and conditions of this Privacy Policy.

Personally Identifiable Information:  Privacy concerns center on information that can be associated with a particular individual or entity.  This information is often referred to as “personally identifiable information”.  Your direct personally identifiable information includes without limitation, such things as a customer’s name, address, telephone number, social security number, or e-mail address.

Disclosure of Personally Identifiable Information:  BCN will not sell, rent or lease to third parties any personally identifiable information obtained from the use of the Site or from the registration for or use of a BCN service nor will BCN disclose any personally identifiable information without your consent except: (i) as required by subpoena or other legal process; (ii) to respond to Federal, State, local, regulatory, quasi-regulatory and lender audits; (iii) to protect against fraud; (iv) to investigate violations of this Privacy Policy, BCN’s Terms of Use, or other agreements that BCN has with you; (v) in the case of imminent physical harm to the customers or others; and/or, (vi) to protect BCN’s or its agents’ property.  BCN may also disclose personally identifiable information to its employees, agents, contractors, affiliates, business partners and other third parties who assist BCN in provisioning service or equipment to you or for provisioning and hosting BCN’s Site.  When BCN uses agents, contractors, business partners or other third parties to perform services on its behalf or in cooperation, BCN will instruct them to protect your personally identifiable information consistent with this Privacy Policy.  BCN may also share your personally identifiable information in the event of a merger, acquisition or sale of all or components of BCN’s or its affiliates’ business.

Use of Personally Identifiable Information:  BCN collects and uses personally identifiable information obtained from you and from other sources for account administration, service provisioning, operations, billings and collections, marketing, analytics, customer service, technical support, managing network performance, and for fraud prevention.  BCN may also use personally identifiable information to investigate and help prevent potential or actual fraudulent or unlawful activity or activity that threatens the network or otherwise violates the customer agreement for service.

Use of Indirect Personally Identifiable on BCN’s MobileApp:  While using BCN’s MobileApp, BCN acts as a data processor with regard to indirect personal identifiable information, which includes without limitation, your device’s contact’s information such as phone numbers and email addresses, and a third party contracted by BCN acts as the data controller of such data. In the course of BCN’s processing and protection of such data, all use will be in conformity with the data controller’s instructions.  Specifically, only when you enable BCN’s MobileApp via system permission on BCNMobile Android and/or BCNMobile iOS, BCN shows personal contacts within the respective application. When you send an SMS message to one of your phone contacts, or when you initiate a call to one of your phone contacts, the phone number is sent securely through BCN’s application programming interface. BCN does not store this number with any other personally identifiable information, and it cannot be directly or indirectly attributed to any person or persons; BCN stores only the phone number and pertinent metadata so as to be compliant with all applicable state and federal laws, and BCN does not share this data with any advertisers or third parties, other than the data controllers, under any circumstances. You can revoke phone contact access on your mobile device at any time, and your BCNMobileApp experience is not hindered or interrupted.  BCNMobile Android and BCNMobile iOS also use Gravatar, only when enabled via settings and UIConfigs, which is a service that provides avatar images linked to the MD5 hash of your email address. This means that, only when Gravatar use is enabled, BCN hashes each contact’s email address and sends it to Gravatar to try and retrieve an avatar image. MD5 hashes cannot be directly or indirectly attributed to any person or persons, and BCN only sends the MD5 hash to Gravatar, never the email address in plain text. As with phone contacts, you can revoke Gravatar access at any time in settings or via UIConfig, and your BCNMobileApp experience is not hindered or interrupted.

Aggregated Data and Anonymized Information: BCN may gather aggregated data, anonymized information, or other information that does not identify a particular person such as the zip codes, sites visited, session lengths, bit rates, and number of messages and bytes passed.  BCN uses this information in the aggregate.  BCN in its discretion may share this information with other parties from time to time and for billing purposes.

Cookies:   BCN uses or may use cookies to, amongst other things, allow the Site and links thereon to recognize repeat users, facilitate users’ access to the Site, and allow the Site and links thereon to compile aggregate data that will allow content improvements and analytics to maintain, protect and develop BCN networks.  If you do not want BCN to use cookies to access information, adjust the settings on your browser program to deny or disable the use of cookies. However, denying or disabling cookies or similar technology may prevent you from accessing some or all of BCN’s content or using some or all of the features on the Site or links thereon.

E-mail:  BCN will not read your outgoing or incoming e-mail, private chat or instant messages.  BCN or its agents may store e-mail messages for a brief period of time and could be compelled to disclose the messages in order to comply with a court order or subpoena, or if it is necessary to disclose this information to protect an individual’s safety or security.

Security:  BCN maintains security measures and policy guidelines to protect your customer identifiable information from unauthorized access.

Children:  BCN does not target children or teenagers for the collection of personally identifiable information.  BCN encourages parents and guardians to spend time online with their children and to participate in and monitor their internet activity.  All minors should have parental consent before using the Internet or disclosing any personally identifiable information online.

Updates to the Privacy Policy: From time to time, BCN may, at its sole and absolute discretion, review and update its Privacy Policy by changing, modifying, adding or removing terms.  When it does so, it will post the updated policy on its Site and note the effective date of the new policy.  Your use or viewing of the Site following notice of such change constitutes your acceptance of the revised policy.  If you do not agree to any portion of the revised policy, then please cease using or viewing the Site.

Notice to California & New Jersey Residents:  BCN complies with the California Consumer Privacy Act, the California Privacy Rights Act and New Jersey’s Consumer Privacy Law (collectively the “Privacy Laws”).  Individuals residing in California or in New Jersey who provide their personally identifiable information to BCN, may request, amongst other things, to: (a) confirm if BCN processes and accesses their personally identifiable information, (b) obtain a copy of their personally identifiable information which has been collected, used or shared during the prior twelve (12) months (unless otherwise directed by you), (c) have their personally identifiable information be deleted, (d) opt out of their personally identifiable information being shared with third parties, and/or (e) correct inaccurate personally identifiable information.  BCN will comply with such a request within 45 days (unless an extension of time is reasonably necessary due to the complexity and number of the individual’s requests), except where the Privacy Laws allow BCN’s retention and use of the personally identifiable information, which may include, but is not limited to, when the personally identifiable information is being used to: complete a transaction, detect or prevent security incidents, detect or repair errors or bugs, exercise free speech, and/or comply with legal or contractual obligations.  Such request must be submitted to BCN at the following address:
